Welcome to Roommate Genius. These Terms of Service ("Terms") govern your use of the Roommate Genius platform, including roommategenius.com, the Roommate Genius web application, and all related services (collectively, the "Service") operated by Roommate Genius, Inc., a Texas corporation ("Roommate Genius," "we," "us," or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into this agreement.
To use account-based features, you must create an account. Some features may require identity, student-status, income, or background verification. If you submit verification information or documents, you authorize Roommate Genius and its service providers to review them for the stated purpose. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your account and for activity under it.
Roommate Genius is a roommate matching platform that connects users seeking shared housing arrangements based on lifestyle compatibility. The Service includes roommate matching for students using supported .edu accounts, roommate matching for general public renters in Dallas, optional background checks through a third-party screening provider (when available and subject to required disclosures and consent), apartment listings ("Apartment Surf"), and landlord SaaS tools.
Roommate Genius does not own, operate, or lease any apartments. We are a technology platform that facilitates introductions and provides tools. All housing decisions are made by you and the parties you choose to engage with.
Roommate Genius is not a real estate broker, landlord, tenant, lessor, lessee, or party to any lease or rental agreement. We do not verify or screen every user. A verification badge reflects only the document review described in the Service and is not a guarantee of identity, conduct, compatibility, safety, or suitability. We do not guarantee the accuracy of user-submitted information, the suitability of any match, or the quality of any apartment listing.
You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant Roommate Genius a worldwide, non-exclusive, royalty-free license to use, display, and distribute it for the purpose of operating the Service.
You agree NOT to submit User Content that is false, misleading, or fraudulent; violates any applicable law including fair housing laws; infringes on others' intellectual property; is harassing, threatening, hateful, or discriminatory; solicits illegal activity; or contains sexually explicit content or content depicting minors inappropriately.
Roommate Genius designs roommate matching around shared-living compatibility. Apartment listings, advertising, landlord tools, and housing decisions must comply with applicable fair housing and anti-discrimination laws. Users and housing providers may not use the Service to discriminate unlawfully or to request that Roommate Genius discriminate on their behalf.
If background screening is offered, it is conducted by a third-party screening provider. Separate disclosures and authorization may be required before a report is obtained. Screening used for housing eligibility is subject to the Fair Credit Reporting Act and other applicable laws, including notice and dispute rights.
Current fees, billing frequency, and included features are displayed before purchase. Payments are processed by Stripe or another disclosed payment provider. All sales are final unless required otherwise by law or stated at checkout. We may change fees prospectively, but changes will not affect completed transactions.
You agree NOT to use the Service for any unlawful purpose; misrepresent your identity or affiliation; harass, threaten, or stalk other users; collect or harvest other users' information; use bots, scrapers, or automated tools to access the Service; resell, sublicense, or commercially exploit the Service without our written permission; circumvent any verification or security measure; or interfere with the Service's operation.
We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, harassment, safety concerns, or any other reason at our discretion. You may close your account at any time by contacting info@roommategenius.com.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnity, and limitation of liability.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ROOMMATEGENIUS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MATCH WILL RESULT IN A SUCCESSFUL ROOMMATE OR HOUSING ARRANGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, ROOMMATE GENIUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Roommate Genius from any claim, demand, or damages arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party right.
PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be held in Dallas County, Texas, or remotely.
YOU AND ROOMMATE GENIUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@roommategenius.com with the subject "Arbitration Opt-Out" and your full name.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
We may update these Terms at any time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
